3This book introduces law in the context of international business. The basics of law are explored using a clear comparative methodology. International and regional economic institutions are discussed, next to the fundaments of private law. These include contract law, liability law, labour law, company law, privacy law, intellectual property law and international private law. The book goes beyond the usual focus on Western legal systems and uses examples from all over the world to provide students with comprehensive knowledge of business law. It is set up rather broadly, so that it can be used by teachers throughout their entire curriculum. Each chapter ends with a clearsummary. With its colourful cases, this book is accessible and fun to read.

The main hypothesis underlying this article is that although arbitrators are not formally part of national justice systems, they have dealt with questions of EU fundamental rights and the European rule of law standards for quite some time, at least formally since the landmark CJEU judgment in Eco Swiss in 1999. In fact, in all forms of arbitration, be it national or international, taking place in or across (Member) States daily and not necessarily concerning the application by arbitrators of EU law stricto sensu, arbitrators can be seen as guardians of many crucial procedural guarantees that increase parties’ access to justice and advance the European rule of law, or so we wish to argue. This article is an exploratory piece. That is, it combines the format of the state-of-the-art review with the format of conference proceedings through which we present the main activities of the DG Justice TRIIAL project concerning arbitration. Our main goal is three-fold: (1) to advance the discussion on the relationship between the European rule of law and arbitration, (2) to present the main findings stemming from research and training activities within the TRIIAL training workshops on arbitration, and (3) to formulate future research and practical questions on the topic at hand.

Het onderwerp IT Governance is in dit decennium in navolging van Corporate Governance ook in het hoger onderwijs op menig bestuurdersagenda terecht gekomen. Het betekent zoveel als deugdelijk IT bestuur. Het belang van IT Governance is onder andere gelegen in het feit dat de kosten van IT (aanschaf, beheer en onderhoud) een belangrijk deel uitmaken van de onderwijsbudgetten. Daarnaast is de strategische potentie van IT momenteel nog onvoldoende benut en liggen er op dat gebied enorme kansen. In dit rapport zijn de resultaten weergegeven van een onderzoek dat betrekking heeft op IT Governance binnen het Hoger Beroepsonderwijs in Nederland. Daartoe zijn tien van de grootste HBO-instellingen bezocht en is aan de CIO's gevraagd welke relatie er bestaat tussen IT Governance en de kwaliteit van het onderwijs (het primair proces). Uit het theoretisch vooronderzoek is gebleken dat er tal van methoden zijn die een instelling kunnen ondersteunen in de uitvoering van IT Governance. Het overgrote deel van deze methoden of raamwerken beperkt zich tot het "wat' van Governance en niet zozeer het "hoe'. In de praktijk blijkt dat er binnen de onderzochte instellingen vaak meerdere methoden impliciet en expliciet gebruikt worden en ook dat meerdere mensen binnen dezelfde instelling meer dan één methode naast elkaar gebruiken. Zodoende ontstaat een lappendeken aan methoden met even zoveel uitgangspunten en filosofieën. Ieder van de onderzochte instellingen heeft een gedelegeerd CIO zonder dat de lijnmacht, behorend bij de formele CIO-positie, mee wordt gedelegeerd. Dit leidt in de praktijk tot een situatie waarin de CIO geen formele macht heeft maar in de meeste gevallen wel invloed. Het feit dat de CIO "niet in de lijn' zit kan er voor zorgen dat de gewenste draagkracht en handelingssnelheid op het gebied van IT worden beperkt. Daardoor zitten de CIO's nu vaak in een spagaat tussen de aanbodkant van IT en de vraagzijde die door het onderwijs ingevuld moet worden. Meestal gebeurt dit via het informatiemanagement. In totaal zijn vanuit de onderzoeksresultaten 13 conclusies getrokken. Deze zijn gerangschikt in een zestal rubrieken. Zo is onder andere de conclusie getrokken dat affiniteit van de bestuurders onontbeerlijk is voor een adequate IT Governance. Deze affiniteit zien we steeds vaker terug bij de portefeuillehouders in de colleges van bestuur. Adequaat impliceert ook een dialoog tussen vraag en aanbod. Aan de vraagzijde (onderwijs) is het IT-bewustzijn onvoldoende ontwikkeld om een invulling te kunnen geven aan het partnerschap in de dialoog tussen onderwijs en IT. De inhoudelijke dialoog kan alleen gevoerd worden indien de resultaten bekend zijn van de inzet van IT ten behoeve van het onderwijs. Deze resultaten zijn vaak bij gebrek aan managementinformatie niet bekend waardoor er in feite geen sprake is van een volwaardige IT-beleidscyclus waarbij resultaten bottom-up input vormen voor beleidsaanpassingen top-down. Tot slot kenmerken de CIO's de eigen onderwijsinstelling vanuit IT-perspectief als procesgedreven. De wens om businessgedreven te werken is duidelijk aanwezig. Er zijn dertien inrichtingsfactoren gevonden die een positieve bijdrage kunnen leveren aan de uitvoering van IT Governance, waaronder de formele aanwezigheid van strategisch IT beleid, het nemen van verantwoordelijkheid en niet alleen het afleggen van verantwoording ten aanzien van IT, en het belang om IT vanuit organisatiekundig perspectief te benaderen in plaats van technische invalshoek. Wellicht de belangrijkste uitspraak van één van de respondenten luidde: "Structuren of methoden werken nooit uit zichzelf, mensen werken!" Deze uitspraak roept direct de volgende vraag op, namelijk "hoe werken ze'.

Copyright enforcement by private third parties – does it work uniformly across the EU? Since the inception of Napster, home copying of digital files has taken a flight. The first providers of software or infrastructure for the illegal exchange of files were held contributory or vicariously liable for copyright infringement. In response, they quickly diluted the chain of liability to such an extent that neither the software producers, nor the service providers could be held liable. Moving further down the communication chain, the rights holders are now requiring Internet Service Providers (ISPs) that provide access to end customers to help them with the enforcement of their rights. This article discusses case-law regarding the enforcement of copyright by Internet Access Providers throughout Europe. At first glance, copyright enforcement has been harmonised by means of a number of directives, and article 8(3) of the Copyright Directive (2001/29/EC) regulates that EU Member States must ensure the position of rights holders with regard to injunctions against ISPs. Problem solved? Case law from Denmark, Ireland, Belgium, Norway, England, The Netherlands, Austria and the Court of Justice of the EU was studied. In addition, the legal practice in Germany was examined. The period of time covered by case law is from 2003 to 2013, the case law gives insight into the differences that still exist after the implementation of the directive.

Objectives: To cross-validate the existing peak rate of oxygen consumption (VO2peak) prediction equations in Dutch law enforcement officers and to determine whether these prediction equations can be used to predict VO2peak for groups and in a single individual. A further objective was to report normative absolute and relative VO2peak values of a sample of law enforcement officers in the Netherlands. Material and Methods: The peak rate of oxygen consumption (ml×kg–1×min–1) was measured using a maximal incremental bicycle test in 1530 subjects, including 1068 male and 461 female police officers. Validity of the prediction equations for groups was assessed by comparing predicted VO2peak with measured VO2peak using paired t-tests. For individual differences limits of agreement (LoA) were calculated. Equations were considered valid for individuals when the difference between measured and predicted VO2peak did not exceed ±1 metabolic equivalent (MET) in 95% of individuals. Results: None of the equations met the validity criterion of 95% of individuals having ±1 MET difference or less than the measured value. Limits of agreement (LoAs) were large in all predictions. At the individual level, none of the equations were valid predictors of VO2peak (ml×kg–1×min–1). Normative values for Dutch law enforcement officers were presented. Conclusions: Substantial differences between measured and predicted VO2peak (ml×kg–1×min–1) were found. Most tested equations were invalid predictors of VO2peak at group level and all were invalid at individual levels.

The American company Amazon has made headlines several times for monitoring its workers in warehouses across Europe and beyond.1 What is new is that a national data protection authority has recently issued a substantial fine of €32 million to the e-commerce giant for breaching several provisions of the General Data Protection Regulation (gdpr) with its surveillance practices. On 27 December 2023, the Commission nationale de l’informatique et des libertés (cnil)—the French Data Protection Authority—determined that Amazon France Logistique infringed on, among others, Articles 6(1)(f) (principle of lawfulness) and 5(1)(c) (data minimization) gdpr by processing some of workers’ data collected by handheld scanner in the distribution centers of Lauwin-Planque and Montélimar.2 Scanners enable employees to perform direct tasks such as picking and scanning items while continuously collecting data on quality of work, productivity, and periods of inactivity.3 According to the company, this data processing is necessary for various purposes, including quality and safety in warehouse management, employee coaching and performance evaluation, and work planning.4 The cnil’s decision centers on data protection law, but its implications reach far beyond into workers’ fundamental right to health and safety at work. As noted in legal literature and policy documents, digital surveillance practices can have a significant impact on workers’ mental health and overall well-being.5 This commentary examines the cnil’s decision through the lens of European occupational health and safety (EU ohs). Its scope is limited to how the French authority has interpreted the data protection principle of lawfulness taking into account the impact of some of Amazon’s monitoring practices on workers’ fundamental right to health and safety.

Informatietechnologie (IT) in de zorg is de laatste jaren een veelbesproken onderwerp. Vooral de ontwikkelingen rond het landelijk Elektronisch Patiënten Dossier (EPD) houden de gemoederen (nog) steeds bezig. Maar hoe is het eigenlijk gesteld met de IT in de zorg? Hoeveel ziekenhuizen maken nu daadwerkelijk gebruik van IT in de dagelijkse zorgprocessen? Welke prioriteiten geven instellingen aan IT-ontwikkelingen? Hoe staat het met de functionaliteit van het EPD in de ziekenhuizen? En, hoe is het gesteld met het elektronisch uitwisselen van informatie met andere instellingen binnen of buiten de zorgketen? Vragen die ons allen aangaan, gezien het belang voor de gezondheid, de zorg en de (hoge) investeringskosten van IT. Het doel van dit onderzoek is inzicht krijgen in de stand van zaken rondom de ontwikkeling van IT in Nederlandse ziekenhuizen. In een later stadium vergelijken we de resultaten met de ontwikkelingen in Duitsland. Ook kijken we naar de ontwikkelingen van het EPD en naar de elektronische gegevensuitwisseling in de afgelopen tien jaar in Nederland.

The IT-monitor gives an overview on the use and implementation of information technology (IT) in general and university hospitals in the Netherlands. Using the questionnaire, earlier applied in Germany and Austria, all Dutch hospitals were requested to participate, of which 20% responded. The results show that the introduction of IT is realised in various activities in several departments of the hospitals. Examples are the Electronic Health Record (EHR), electronic medical correspondence and diagnostic tests such as radiology. Desktops are most commonly used, but laptop and notebook are also used. On the other hand, IT use for medical guidelines, clinical pathways and clinical reminders are not generally introduced. Five reasons are named as barriers for the introduction: lack of financial support, shortage of staff, inadequate suppliers, lack of support by doctors and difficulties in showing the return of investment. With a larger budget available, hospitals will increase the development of IT on various areas in the hospital departments in the near future towards a more eHealth orientated Dutch healthcare.
