Legal departments play a pivotal role in the quality of contracts and contracting processes within an organization. This article reflects on current developments and innovations in contracting practice and their impact on the role of legal professionals and legal departments within organizations. Based on empirical research among legal professionals and legal departments in Dutch legal practice, the article positions contracts and contracting within the legal function of an organization and discusses developments in contract management, automated contract assembly and legal design and their potential impact on the role of legal professionals and legal departments. Finally, areas for future research are identified. Throughout the article, the focus is on large commercial organizations.

This paper takes a process perspective in exploring the influence of social interaction on the dynamics of psychological contracting throughout organizational change. Although social interaction is a key focus in social exchange theory, this aspect is largely overlooked in the current psychological contract literature. In this qualitative study, we adopt a retrospective design, asking change recipients to recollect events over time in the context of digital transformation in Dutch travel organizations. Our data reveal a sequence of different kinds of social interactions over the course of a change process, from collective-focused interactions (i.e., kindness and sharing) in stable contracts to transactional interactions (i.e., “what is in it for me”) following psychological contract disruption, to relational interactions (i.e., vigilance about equity in social exchange) in psychological contract repair, and to a final return to resonance and alignment with others and a return to psychological contract maintenance. Our results suggest that social interactions play a more potent role in the dynamics of psychological contracting than is currently recognized in the literature. Finally, we discuss a number of implications for dynamic models of psychological contracting.

Abstract: The key challenge of managing Floating Production Storage and Offloading assets (FPSOs) for offshore hydrocarbon production lies in maximizing the economic value and productivity, while minimizing the Total Cost of Ownership and operational risk. This is a comprehensive task, considering the increasing demands of performance contracting, (down)time reduction, safety and sustainability while coping with high levels of phenomenological complexity and relatively low product maturity due to the limited amount of units deployed in varying operating conditions. Presently, design, construction and operational practices are largely influenced by high-cycle fatigue as a primary degradation parameter. Empirical (inspection) practices are deployed as the key instrument to identify and mitigate system anomalies and unanticipated defects, inherently a reactive measure. This paper describes a paradigm-shift from predominant singular methods into a more holistic and pro-active system approach to safeguard structural longevity. This is done through a short review of several synergetic Joint Industry Projects (JIP’s) from different angles of incidence on enhanced design and operations through coherent a-priori fatigue prediction and posteriori anomaly detection and -monitoring.

Respiratory pathogens like Streptococcus pneumoniae can cause severe pneumonia. Nonetheless, mechanically ventilated intensive care patients, who have a high risk of contracting pneumonia, rarely develop pneumococcal pneumonia. Mechanically ventilated patients are at risk of contracting pneumonia. Therefore, these patients often receive prophylactic systemic antimicrobial therapy. Intriguingly however, a previous study showed that antimicrobial activity in bronchoalveolar aspirates (here referred to as “sputa”) from ventilated patients was only partially explained by antibiotic therapy. Here we report that sputa from these patients presented distinct proteome signatures depending on the presence or absence of antimicrobial activity. Moreover, we show that the same distinction applied to antibodies against Streptococcus pneumoniae , which is a major causative agent of pneumonia. Specifically, the investigated sputa that inhibited growth of S. pneumoniae , while containing subinhibitory levels of the antibiotic cefotaxime, presented elevated levels of proteins implicated in innate immune defenses, including complement and apolipoprotein-associated proteins. In contrast, S. pneumoniae -inhibiting sputa with relatively high cefotaxime concentrations or noninhibiting sputa contained higher levels of proteins involved in inflammatory responses, such as neutrophil elastase-associated proteins. In an immunoproteomics analysis, 18 out of 55 S. pneumoniae antigens tested showed significantly increased levels of IgGs in inhibiting sputa. Hence, proteomics and immunoproteomics revealed elevated levels of antimicrobial host proteins or S. pneumoniae antigen-specific IgGs in pneumococcal growth-inhibiting sputa, thus explaining their anti-pneumococcal activity. IMPORTANCE Respiratory pathogens like Streptococcus pneumoniae can cause severe pneumonia. Nonetheless, mechanically ventilated intensive care patients, who have a high risk of contracting pneumonia, rarely develop pneumococcal pneumonia. This suggests the presence of potentially protective antimicrobial agents in their lung environment. Our present study shows for the first time that bronchoalveolar aspirates, “sputa,” of ventilated patients in a Dutch intensive care unit were characterized by three distinct groups of proteome abundance signatures that can explain their anti-pneumococcal activity. Importantly, this anti-pneumococcal sputum activity was related either to elevated levels of antimicrobial host proteins or to antibiotics and S. pneumoniae -specific antibodies. Further, the sputum composition of some patients changed over time. Therefore, we conclude that our study may provide a novel tool to measure changes that are indicative of infection-related conditions in the lungs of mechanically ventilated patients.

Organizations in legal practice, under pressure to do “more for less,” are searching for ways to automate legal work, to improve efficiency of legal service delivery. Automated drafting of contracts (or: contract automation) is one of the areas where technology is—partly—replacing legal professionals. In Dutch legal practice, the number of organizations that are actively deploying contract automation is still relatively small, but growing. This chapter looks at experiences with contract automation of organizations from various sectors in Dutch legal practice. Contract automation can improve legal service delivery to consumers and SMEs, as well as contracting processes within organizations. Several organizations report positive results. However, successfully implementing contract automation, especially for internal use within organizations, is not simple. Tight budgets, resistance to change and poor integration with other software are some of the problems that organizations may encounter. Generally, human and organizational factors are often at least as important as the technological aspects. Successful implementation of contract automation requires design thinking, a proactive approach and process-oriented (legal) professionals. Regardless of these difficulties, the use of contract automation software in Dutch legal practice can be expected to increase, due to several factors. The number of organizations that are offering contracts (and other legal documents) online to SMEs and consumers has grown rapidly over the last years. Contract automation is not only offered to consumers and SMEs by commercial parties, but also by branch organizations, as a service to their members. Consumers and SMEs will become used to these self-help solutions for legal matters. Legal publishers are also increasing the offering of automated contracts and other legal documents. In addition, law firms and consultants are promoting the use of contract automation within client organizations. Finally, many corporate organizations are increasingly exchanging experiences on improving legal operations and the use of Legal Tech, including contract automation. Eventually, increased use of contract automation may drive further harmonization of contracts within sectors and facilitate other technological applications, such as the automated analysis of contracts.

This study aims to investigate the pandemic’s effect on Dutch travelers’ future behavioral willingness to travel eco-friendly. The conceptual framework includes the Norm-Activation Model (NAM), behavioral willingness to pro-environmental travel, economic sacrifices theory, and risk perception. These factors have proved to influence pro-environmental travel behavior (PETB) in a during-crisis world. This research contributes to filling intriguing gaps in the literature on the effect of COVID-19 on the future Pro-Environmental Travel Behavior (PETB) of Dutch travelers. The research process involved an online self-administered method created with one of the leading research and web-based survey tools, Qualtrics. Respondents (329) filled out the questionnaire. The results revealed that the pandemic affected the willingness of travelers to travel pro-environmentally. COVID-19 as a disease is not necessarily seen as a threat, while the long-lasting impacts that COVID-19 brings are seen as a threat. Most Dutch travelers are more concerned about the economic and long-term health consequences of the virus than they are about contracting or dying from it. The majority of individuals are concerned about climate change and feel responsible for it.
