Terms of use Publinova

Welcome to Publinova, the online platform for knowledge dissemination and collaboration within the world of practice-based research. On Publinova you can search, find, share and connect. It offers researchers, supporters, lecturers and interested parties one central place to share knowledge with professional peers and the general public. Publinova is provided by SURF B.V.

As a visitor to Publinova, you can find information about research results, projects, parties involved and researchers. You can contact researchers and share information via social media or other websites. As a logged in user of Publinova, you can use even more features of the platform, such as following updates in your field or posting comments.

You can log in via SURFconext or EduID, and as a researcher (and in some cases as a supporter) you can manage and edit your own research results. Moreover, you can comment on the work of other researchers, find collaboration partners and present your own expertises, collaborations and products.

In these terms of use, you will find the rules of conduct for Publinova, as well as the rights and obligations that apply when using Publinova.

  1. Definitions
    1.1 A number of definitions are used in these Terms of Use. Definitions are capitalized.
    Visitor: Natural person who visits Publinova. Visitor has the following rights on Publinova: viewing and searching Content on Publinova, sharing Content via social media and downloading Content. A Visitor is not equivalent to a User.
    Comments: Posting comments and/or reactions to Content. Comments can be added to Content by all Users. No specific rights need be given by the Educational Institution responsible for the Content.
    Content: Additions - including but not limited to publications, descriptions, metadata, visual and audio material, research results that are automatically placed on Publinova from the source systems of an educational institution, as well as all manual additions by Users who have been granted rights by an educational institution to make those additions. The Educational Institution concerned is responsible for the aforementioned information on Publinova.
    User: Natural person, who logs on to Publinova.
    Terms of Use: These terms and conditions of use.
    Educational Institution: Educational Institution located in the Netherlands that is responsible for the Content posted on Publinova under its responsibility. The Educational Institution determines the allocation of rights of use of its Content for all Users.

    SURF: SURF B.V. SURF makes the platform Publinova available.

  2. Rights and obligations of the User
    2.1 By default, a User has the following user rights on Publinova: create, modify, enhance and delete personal profile page, distribute rights on one's own profile page, link another appearance of the User to the User's profile (alias linking), provide Comments on Content, follow and unfollow Content, get an overview and manage notifications, followed and favorite Content. Educational Institutions may grant additional usage rights to a User, such as being able to manually add or modify Content. A User can request these additional rights from the Educational Institution.
    2.2 The User will comply with these Terms of Use.
    2.3 The User uses Publinova in accordance with these Terms of Use, with specific reference to Article 3 Misuse.
    2.4 A User's profile on Publinova is strictly personal. The User is not permitted to transfer or give use of his profile and resulting access to a third party.

  3. Abuse
    3.1 Abuse means - but is not limited to - using Publinova in a manner for which the platform is not intended. Abuse includes, in any case:

    • Using Publinova to advertise products, services or a company
    • Sending spam messages to Users of Publinova
    • Phishing or identity fraud
    • Spreading computer viruses, worms, Trojan horses or other malicious code
    • Excessive criticism of an idea, article or person
    • Infringing on intellectual property or other proprietary rights of others
    • Posting Content and/or Comments on Publinova that contain offensive or discriminatory statements and/or personal attacks
    • Posting Content and/or Comments that violate the law, public order or morality
      3.2 It is prohibited to use Publinova in any of the abovementioned forms of Abuse or in any other way that is inconsistent with social standards and values.
  4. Consequences of Abuse
    4.1 Content and/or Comments that do not comply with socially accepted norms and values or in the cases referred to in Clause 3 may be removed by SURF.
    4.2 SURF will inform the User in the event of Misuse.
    4.3 If SURF has reason to believe that certain information or communication by the User infringes or threatens to infringe rules or obligations as set out in these Terms and Conditions of Use, the User will be obliged, in consultation with SURF and the Educational Institution concerned, to put an end to said infringement as soon as possible and to prevent it from occurring in future.
    4.4 SURF reserves the right to block a User on Publinova (immediately) without giving reasons.
    4.5 SURF will also be entitled to take other measures necessary to protect SURF, Users, and/or third parties against damage, nuisance, or infringements of rights.

  5. Liability
    5.1 The User is responsible for his/her own actions regarding the posting of Comments on Publinova.
    5.2 SURF accepts no liability from third parties arising from non-compliance with the Terms and Conditions of Use or the posting of Comments on Publinova by the User.

  6. Intellectual property rights
    6.1 Content on Publinova is made available in open access as much as possible, taking into account the intellectual property rights vested in a work. Open access means making works available subject to the applicable open access license conditions.
    6.2 Publinova obliges the User to make Content available on the platform in open access as much as possible, stating the applicable Creative Commons license(s).
    6.3 If third party rights are vested in a work, the User must ensure that he/she has permission to place the work on Publinova. To the extent that an open access license is attached to the relevant work of third party or parties, the User shall mention the relevant open access license terms and conditions belonging to this work (on Publinova).
    6.4 For more information about open access publishing and the various licensing conditions, the relevant Educational Institution is the point of contact.

  7. Duration Publinova
    7.1 No rights can be derived from the provision of Publinova including the Content and/or Comments posted on it in terms of Publinova's term or duration.

  9. Applicable law
    9.1 These Terms of Use are governed by Dutch law and the competent court is the District Court of Midden-Nederland, location Utrecht.

  10. Modification of the Terms of Use
    10.1 SURF reserves the right to amend these Terms and Conditions of Use and the privacy and privacy and cookie policy.
    10.2 Publinova therefore recommends regularly checking this page to see whether any changes have been made.
