Is that lawful?

Data collected from fitness trackers worn by employees could be very useful for businesses. The sharing of this data with employers is already a well-established practice in the United States, and companies in Europe are showing an interest in the introduction of such devices among their workforces. Our argument is that employers processing their employees’ fitness trackers data is unlikely to be lawful under the General Data Protection Regulation (GDPR). Wearable fitness trackers, such as Fitbit and AppleWatch devices, collate intimate data about the wearer’s location, sleep and heart rate. As a result, we consider that they not only represent a novel threat to the privacy and autonomy of the wearer, but that the data gathered constitutes ‘health data’ regulated by Article 9. Processing health data, including, in our view, fitness tracking data, is prohibited unless one of the specified conditions in the GDPR applies. After examining a number of legitimate bases which employers can rely on, we conclude that the data processing practices considered do not comply with the principle of lawfulness that is central to the GDPR regime. We suggest alternative schema by which wearable fitness trackers could be integrated into an organization to support healthy habits amongst employees, but in a manner that respects the data privacy of the individual wearer.

Advies voor een Sport & Spel plaza binnen WoonZorgcentrum Nieuw Berkendael

WZH Nieuw Berkendael biedt verpleeghuiszorg aan jonge cliënten met Niet Aangeboren Hersenletsel, neurologische aandoeningen en comazorg, dagbehandeling voor cliënten met een somatische zorgvraag en/of met niet aangeboren hersenletsel en AWBZ en/of eerstelijns behandeling aan (jonge) cliënten met niet aangeboren hersenletsel (zowel chronisch als revalidatieafdeling) en cliënten met neurologische aandoeningen. Onderscheidend t.o.v. de concurrent: de doelgroep betreft met name mensen tussen de 18 en 65 jaar met complexe problematiek, veelal ten gevolge van recent verworven hersenletsel. Op de eerste etage in het gebouw van Nieuw Berkendael is een grote ruimte cq atrium. Dit atrium wordt beschikbaar gesteld voor een sport & spel plaza, zodat cliënten en bezoekers een scala hebben aan recreatieve mogelijkheden. De opdracht die vanuit WZH Nieuw Berkendael komt luidde als volgt:'ontwerp een sport & spel plaza voor de NAH cliënten'. Het ontwerpdoel betreft het atrium op de eerste etage van het woonzorgcentrum Nieuw Berkendael. Het gaat dan in eerste instantie om de cliënten uit het verzorgingstehuis. Het is de bedoeling dat deze ruimte een plek gaat worden waar de cliënten met hun familie actieve spellen maar ook bordspellen kunnen spelen. De cliënten moeten zonder begeleiding van het personeel deel kunnen nemen aan de spellen. Na het afnemen van een enquête zal duidelijk worden wat de cliënten graag willen en of dat er naast de spellen ook behoefte is aan het opknappen van de ruimte. In dat geval zal de inrichting worden meegenomen in het adviesprotocol. Vanuit WZH Nieuw Berkendael zijn er ook nog een aantal randvoorwaarden gesteld: - Het sport & spel plaza moet een beperkt aantal prikkels bevatten. - De wegen moeten vrij gehouden worden in verband met veiligheidsroutes. - De kosten moeten beperkt blijven.

The wardrobe as a system: exploring clothing consumption through design fiction

This study offers a new perspective on clothing consumption by uncovering the systemic nature of the wardrobe. The research builds on systems theory and aims at drawing a map of the wardrobe as a system with particular structure and behaviour. By co-designing fictional 'smart wardrobe' services with experts and discussing these services with wardrobe users, we identify characteristics of wardrobe structure and behaviour that give input for a preliminary wardrobe map. Lastly, the wardrobe map provides a basis for discussing sustainable design approaches aimed at reducing clothing demand, in the context of growing clothing production volume and its associated environmental impacts.

Creating Multiple Value Through Social Business Collaboration

There is increasing evidence of inter-organizational or cross-sector collaboration between social enterprises and for-profit companies to address sustainability challenges. Despite the emerging interest in such collaboration, the actual processes behind it often remain a ‘black box’. This case study contributes to filling that gap in the literature, by zooming in on the multi-faceted collaboration between IKEA —a global home furnishings retailer— and i-did, a small but ambitious Dutch social enterprise. This case shows that despite significant joint value creation, the collaboration so far has mainly impacted the social enterprise and has not had noticeable wider outcomes on IKEA or beyond the partnership. Nevertheless, continued collaboration can provide a basis for the generation of mutual value and to further explore and innovate around social and circular business models. We conclude by summarising lessons-learned for the benefit of for-profit companies and social enterprises exploring partnerships to address sustainability challenges.
